Terms of Service

By accessing or using ClubRaha (the "Platform"), including by confirming that you are 18 or older on our age confirmation screen, you agree to be bound by these Terms of Service, our Privacy Policy, our Cookie Policy and our Community Guidelines. If you do not agree, you must not use the Platform.

We may update these terms at any time. Continued use of the Platform after an update means you accept the updated terms.

The Platform is strictly for adults. You must be at least 18 years old, and of legal age in your place of residence, to access the Platform, create an account or publish a listing.

You confirm that viewing adult-oriented material is lawful where you are. If it is not, you must leave the Platform immediately.

ClubRaha is an online advertising directory. It provides space where independent adult advertisers publish their own listings, and where visitors can view those listings.

ClubRaha does not:

• employ, manage, represent, act as agent for, or control any advertiser;
• arrange, book, broker or take part in any meeting, transaction or arrangement between users;
• receive any share of, or commission on, any payment between users;
• verify the identity, age, background, claims or conduct of any advertiser or visitor, except where expressly stated;
• endorse, recommend or guarantee any advertiser, listing or service.

Fees paid to the Platform are solely for advertising space and listing placement. Any contact, meeting or arrangement between users happens entirely outside the Platform and is solely the responsibility of those users.

If you publish a listing, you confirm and agree that:

• you are at least 18 years old and every person shown in your listing is at least 18 years old and has consented to appear;
• you are acting independently, of your own free will, and are not being coerced, controlled or exploited by anyone;
• you own or have permission to use all photos and content you upload;
• your listing is accurate and does not impersonate anyone;
• you will not offer, advertise or arrange any service or activity that is unlawful where you or the other person are;
• you are solely responsible for your listing, your communications and your conduct, and for complying with all applicable laws, including tax laws.

You must not use the Platform to:

• involve, depict or advertise any person under 18, in any way;
• facilitate human trafficking, forced labour, coercion or exploitation of any kind;
• post content of anyone without their consent, including intimate images;
• harass, threaten, defraud, blackmail or harm anyone;
• advertise or facilitate anything illegal;
• post malware, spam, or attempt to access accounts, systems or data you are not authorised to access.

We have zero tolerance for content involving minors or trafficking. Such content will be removed, the account terminated, and the matter may be reported to the relevant authorities.

All listings, photos, descriptions and other content are created and published by users. The ClubRaha Parties do not create, review in advance, edit or adopt user content, and are not responsible for it. Views and claims in any listing are those of its author only.

By uploading content you grant the Platform a non-exclusive, royalty-free licence to host, store, display and format that content solely for operating the Platform. You remain the owner of your content.

We may, but are not obliged to, remove or restrict any content or account at our sole discretion, with or without notice.

Meeting people you have found online carries real risks. You use the Platform and interact with other users entirely at your own risk. Take sensible precautions: meet in public first, tell someone you trust where you are going, and never send money to people you have not met. See our Community Information page for safety tips.

The ClubRaha Parties are not responsible for the conduct, online or offline, of any user.

Listing packages are paid in advance through our third-party payment provider. Payments are for advertising placement for the selected period only and are non-refundable, except where required by law. Listings may be removed for breach of these terms without refund.

The Platform and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. The ClubRaha Parties do not warrant that any listing is accurate, lawful or safe, or that the Platform will be uninterrupted or error-free.

To the fullest extent permitted by law, the ClubRaha Parties will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, reputation or goodwill, arising from or related to: your use of, or inability to use, the Platform; any content posted by any user; any contact, meeting, transaction or arrangement between users; or any act or omission of any user or third party, whether online or offline.

Where liability cannot be excluded, the total liability of the ClubRaha Parties is limited to the amount you paid to the Platform in the three (3) months before the claim arose.

You agree to defend, indemnify and hold harmless ClubRaha, its owners, operators, developers, contractors, service and hosting providers, and each of their respective affiliates, officers, employees and agents (together, the "ClubRaha Parties") from and against any claims, liabilities, damages, losses, fines, costs and expenses (including reasonable legal fees) arising from or related to your use of the Platform, your content, your conduct, your dealings with any other person, or your breach of these terms or of any law.

Because the Platform is not involved in dealings between users, you release the ClubRaha Parties from all claims, demands and damages of every kind, known and unknown, arising out of or connected with any dispute you have with another user or third party.

If you believe any content is unlawful, involves a minor, was posted without consent or infringes your rights, report it to support@example.com. We review reports and may remove content. We may disclose information to law enforcement where we are legally required to do so or where we believe in good faith that it is necessary to protect someone from serious harm.

We may suspend or terminate your access at any time, for any reason, including breach of these terms. Sections that by their nature should survive termination (including 6, 9, 10, 11 and 12) will survive.

These terms are governed by the laws of the Republic of Kenya. If any provision is found unenforceable, the remaining provisions remain in full effect.
